Terms of service

These Terms of Service (“Terms”) govern your use of HYRESULT’s websites, applications, accounts, athlete profile claims, follow features and analytical tools (together, the “Service”). The Service is operated by HYRESULT GmbH (“HYRESULT”, “we”, “us” or “our”).

By creating or using an account, claiming an athlete profile or otherwise using an account feature, you agree to these Terms. If you do not agree, do not use those features. Our Privacy Policy explains how we process personal data. Our statutory company and contact details are on the Legal information page.

1. Eligibility and accounts

• You must have the legal capacity to enter into these Terms. If you are a minor, you may use account features only with the permission of a parent or legal guardian where required by law.
• You may sign in through a supported identity provider, currently Google or Apple. You must provide accurate account information, keep access to your account secure and promptly notify us if you suspect unauthorized use.
• You may not impersonate another person, create an account for unlawful purposes, transfer your account to another person or interfere with the security or operation of the Service.
• Unless we expressly permit otherwise, each person may maintain only one account. You remain responsible for activity performed through your account to the extent permitted by law.

2. The Service

HYRESULT provides tools for discovering and following athletes and events, reviewing race results, comparing performance and generating analytical insights. We may add, change or discontinue features over time. Unless a feature is expressly offered as paid, the Service is provided without charge. Any future paid feature will be subject to the price and additional terms shown before purchase.

The official sources for HYROX events, race results, rules and championship qualification are hyrox.com and results.hyrox.com. HYRESULT is an independent service and is not affiliated with, endorsed by or sponsored by HYROX or its rights holders.

3. Athlete data and race results

• Athlete profiles and race information may originate from public race sources, the athlete, other users or our own calculations. Public information can be incomplete, delayed or incorrect.
• HYRESULT does not alter official race records. Corrections to an official result must be directed to the event organizer or official results provider.
• Rankings, comparisons, predictions and other insights are informational estimates. They are not official results and do not constitute medical, coaching, legal or other professional advice.
• If you identify inaccurate personal data, you may ask us to review it using the contact details below. Data-protection requests are handled as described in our Privacy Policy.

4. Claiming an athlete profile

A profile claim links an account to a public athlete profile and may allow the claimant to manage the athlete’s name, nation, Instagram handle and associated races. To protect athletes from impersonation, we may require identity or race-participation verification before or after approving a claim.

By submitting or maintaining a profile claim, you confirm that:

• you are the real person identified by that athlete profile, or, only where HYRESULT expressly permits it, you are a verified legal representative authorized to act for that person;
• the information and evidence you submit are accurate, current and not misleading, and you will keep managed profile information accurate;
• you have the rights needed to provide any submitted content, including an Instagram handle or profile image, and your changes do not infringe another person’s rights; and
• you request that HYRESULT associate the profile and relevant races with your account and process that data to operate the profile, produce race analytics and generate performance insights as described in the Privacy Policy.

Claiming a profile does not give you ownership of underlying official race records or permit you to hide accurate public records merely because they are unfavorable. We may reject, pause or revoke a claim, request further evidence, correct or restore source data, merge duplicate profiles and resolve conflicting claims where reasonably necessary to protect athletes, data quality or the Service.

5. Follows and notifications

Account holders may follow athletes and events and may receive related in-product, email or push notifications where those options are available. We may also send technical or service-related emails, such as security, account, claim-verification or material Terms notices. These messages are not promotional communications. Following does not create a relationship with, or endorsement by, the followed athlete or event. You can change available notification settings or unfollow at any time.

6. Privacy, security and artificial intelligence

• Personal data is processed for the purposes and on the legal bases described in our Privacy Policy. That policy also explains retention, recipients, international transfers and your GDPR rights.
• We apply technical and organizational safeguards appropriate to the risk. These include TLS for data in transit and AES-256 encryption at rest for systems under our control or equivalent protections supplied by our service providers, as described in the Privacy Policy. No transmission or storage system can be guaranteed to be completely secure.
• Where we use an external AI model provider to process personal data, we use enterprise or API configurations designated for Zero Data Retention (“ZDR”) and prohibit use of submitted content to train the provider’s models. AI-generated outputs may be inaccurate and should not be treated as official results or professional advice.
• Where personal data is transferred from the European Economic Area to the United States, we use a lawful transfer mechanism. This may include the EU–U.S. Data Privacy Framework for a recipient whose active certification covers the relevant data, or other safeguards such as the European Commission’s Standard Contractual Clauses.

7. Your content and feedback

You retain any rights you hold in content you submit. You grant HYRESULT a non-exclusive, worldwide, royalty-free license to host, reproduce, technically adapt, analyze and display that content only as needed to operate, secure and improve the Service and provide the features you request. This license ends when the content is deleted from active systems, except to the extent retention is legally required, needed to resolve disputes or continues temporarily in protected backups.

If you provide ideas or general feedback, we may use them without restriction or payment, provided we do not publicly identify you without permission.

8. Acceptable use

You must not:

• submit false claims, impersonate an athlete or manipulate profile associations or race information;
• upload unlawful, infringing, deceptive, malicious, discriminatory or privacy-invasive content;
• scrape, harvest or access the Service by automated means except as expressly permitted by us or applicable law;
• bypass access controls, probe for vulnerabilities, introduce malware, overload the Service or interfere with another user; or
• use the Service or its data to make unlawful decisions about a person or for unauthorized advertising, surveillance or profiling.

9. Intellectual property

The Service, including its software, design, original text, graphics, calculations and HYRESULT branding, is protected by intellectual property laws. Except where these Terms or applicable law permit it, you may not copy, modify, distribute, sell, license or create derivative works from the Service. Third-party names, marks and content remain the property of their respective owners.

10. Availability, suspension and account deletion

We aim to keep the Service available but do not promise uninterrupted or error-free operation. Maintenance, security incidents, provider outages or events beyond our reasonable control may affect availability.

You may stop using the Service at any time and request account deletion using the contact details below. We may restrict or suspend access where reasonably necessary to investigate a profile claim, protect a person or the Service, comply with law or address a material breach of these Terms. Where appropriate, we will provide notice and an opportunity to respond. The Privacy Policy explains what deletion does and which records may need to be retained.

11. Liability

HYRESULT’s liability is governed by the statutory provisions.

12. Changes to these Terms

We may update these Terms for legal, security, technical or service changes. If a change materially affects account holders, we will give reasonable advance notice through the Service or by email where practicable. The updated Terms apply from the stated effective date. If you do not agree to a material change, you may stop using the affected account features and request account deletion.

13. Governing law and final provisions

German law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of mandatory protections under the law of the country where you habitually reside. Mandatory rules on jurisdiction remain unaffected.

If any provision of these Terms is unenforceable, the remaining provisions remain in effect. Separate terms may apply to specific services. In particular, advertising bookings are governed by our General terms and conditions for advertisers; those terms prevail for an advertising booking if they conflict with these Terms.
